The Aluminum Foil Container Manufacturers Association (AFCMA) in the US has backed the country’s Department of Commerce’s final determinations regarding imports of disposable aluminium containers from China.
The department has determined that imports of disposable aluminium containers, pans, trays, and lids from China are being sold in the US at unfairly low prices and are also receiving improper subsidies from the Chinese government.
The body has set final antidumping margins, ranging from 193.90% to 287.80%, along with a final countervailing duty margin of 317.85%, which applies to all Chinese producers and exporters of disposable aluminium containers.
Additionally, the department issued final affirmative critical circumstances determinations, enabling antidumping and countervailing duties to be applied to imports entering the US 90 days before the preliminary rulings, addressing a “surge” in Chinese imports.
The investigation was initiated after petitions were filed seeking relief on behalf of AFCMA and some of its individual members.
The next step will be the US International Trade Commission’s (USITC) final proceedings to assess whether imports of disposable aluminium containers from China are causing or threatening material injury to domestic producers.
The USITC is set to announce its final determination on 11 April 2025.
The aluminium containers involved in these investigations are made primarily from flat-rolled aluminium.
AFCMA counsel John Herrmann said: “The Commerce Department’s final determinations demonstrate a robust commitment to combatting unfair trade through strong enforcement of the US trade laws.
“These determinations bring domestic producers of disposable aluminium container one step closer to securing relief from a surge in low-priced, unfairly traded imports from China.”
